What Does This Privacy Policy Cover?
This Privacy Policy covers GigaOM’s treatment of personally identifiable information (“Personal Information”) that GigaOM gathers when you are accessing the GigaOM Pro Site and when you use the GigaOM Pro services. Also, this Privacy Policy covers GigaOM’s treatment of any Personal Information that GigaOM’s business partners share with GigaOM. This Privacy Policy does not apply to the practices of companies that GigaOM does not own or control, or to individuals that GigaOM does not employ or manage.
What Personal Information Does GigaOM Collect?
GigaOM does not collect your Personal Information except when knowingly provided by you. The types of Personal Information collected may include your full name, website URL, e-mail address, mailing address, telephone number, credit card number, blog or other personal website URL, your nickname or screenname, and any other information that would allow GigaOM to identify you or contact you if needed.
In addition to the Personal Information listed above, we may ask you to provide certain other information such as general demographic information, including age, gender, ZIP code, preferences, and interests. The information we gather from our users enables us to personalize and improve our services.
From time to time, GigaOM may offer downloadable products and/or research services – such as analyst webinars -through the GigaOM Pro Site. If you wish to obtain such products and/or research services, you will be asked to provide additional Personal Information to the information listed above, such as your professional title, the company you work for, the number of employees of the company, and the industry in which you work. Downloading products and/or research through the GigaOM Pro Site is completely voluntary and you therefore have a choice whether or not to disclose this information.
You always have the option not to provide the information requested. If you choose not to provide the information we request, you can still visit most of the GigaOM.com websites, but you may be unable to access certain features and services provided by GigaOM. When you register to receive any products or services from GigaOM or provide information to GigaOM in any other manner, you agree to provide only true, accurate, current and complete information.
We may receive and store any information you enter on the GigaOM Pro Site or provide to us in any other way. The Personal Information you provide may be used for providing attribution to comments you post, to operate and improve the GigaOM Pro Site, to better deliver the our services, to fulfill the products and services you request, to customize the advertising and content you see, to contact you for service or marketing related purposes, and to allow your friends to communicate with you and use the online community aspects of our services.
When you register for an online account on the GigaOM Pro Site (a “Pro Account”), we collect certain Personal Information from you. We also may collect Personal Information from you when you contact us about your subscriptions or participate in certain activities, such as forums, message boards, chats, submitting a letter to the editor, creating a community profile, or rating, tagging and commenting on articles or surveys. We do not, however, knowingly collect Personal Information from children under the age of thirteen. When you provide Personal Information to us, we will make sure you are informed about the types of uses we will make of the information to the extent it is being used in a manner that differs from what is allowed pursuant to this Privacy Policy.
Cookies
A cookie is a string of information that a website stores on a visitor’s computer,and that the visitor’s browser provides to the website each time the visitor returns. GigaOM Pro uses cookies to help GigaOM identify and track visitors, their usage of GigaOM websites, and their website access preferences. GigaOM visitors who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using GigaOM’s websites, with the drawback that certain features of GigaOM’s websites may not function properly without the aid of cookies.
Sharing of Personal Information
Except as described in this Privacy Notice, your personal information will be used only by GigaOM and its controlled subsidiaries and affiliates, and your Personal Information will not be disclosed to any other third party without your consent.
However, there are some individual cases where we may share your Personal Information with specific third parties. We share your Personal Information only with your consent or based on your voluntary actions as described below:
Business Partners: If you have elected to register for one of our webinars, or download free research from the GigaOM Pro Site, we may share your Personal Information with the business partner and/or vendor who provided, sponsored or otherwise made available information products or research services from GigaOM Pro (e.g., sponsored GigaOM Pro Analyst webinars). These business partners and/or vendors may use your Personal Information to contact you for additional information on their products or services.
Agents: We may employ other companies and people to perform tasks on our behalf and need to share your information with them to provide products or services to you. Unless we tell you differently, GigaOM’s agents do not have any right to use Personal Information we share with them beyond what is necessary to assist us. You hereby consent to our sharing of Personal Information for the above purposes.
Business Transfers: In some cases, we may choose to buy or sell assets. In these types of transactions, user information is typically one of the business assets that is transferred. Moreover, if GigaOM, or substantially all of its assets, were acquired, user information would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of GigaOM may continue to use your Personal Information as set forth in this policy.
Corporate or Third-Party Subscriptions: If your subscription is provided in whole or in part by your employer or other third party, we may notify the provider when you access or use your subscription. When providing these notices, we may reveal limited amounts of your personally identifiable information such as your name or email address.
Protection of GigaOM and Others: We may release Personal Information when we believe in good faith that release is necessary to comply with any law; enforce or apply our terms of use and other agreements; or protect the rights, property, or safety of GigaOM, our employees, our users, or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.
Security and Protection of Personal Information
We maintain reasonable standards of security and confidentiality and store Personal Information collected in a database. However, while we employ reasonable standards of security, no security system is impenetrable. For most internet sites, it is possible that third parties may unlawfully intercept or access transmissions you transmit. As such, GigaOM cannot guarantee the security of our database, nor can we guarantee that information you supply won’t be intercepted while being transmitted to GigaOM over the internet. We recommend that you do not disclose your password or confirmation number (as applicable) to anyone.
E-mail Communications
Upon registration for events and/or services provided by GigaOM, we may send you daily or weekly e-mails. If you do not want to receive e-mail or other mail from us, please notify us by e-mail at pro-support@gigaom.com and include sufficient information for us to identify your account, including your name, email address and the specifics of your request. However, after you unsubscribe to cease receiving e-mails, GigaOM Pro may still contact you via e-mail for administrative or informational purposes, including messages regarding the administration of your account and/or any services or events to which you have registered.
Changes to this Privacy Policy
GigaOM retains the discretion to amend or modify this Privacy Policy from time to time. Use of information we collect now is subject to the Privacy Policy in effect at the time such information is collected. If we make changes in the way we use Personal Information, we will notify you by posting an announcement on the GigaOM Pro Site, and such changes shall be effective immediately upon posting. You agree to review this Privacy Policy periodically to ensure that you are aware of any changes. Your continued access or use of the website and/or the services shall be deemed your conclusive acceptance of any amendments and/or modifications.
